Truck Accident Laws
It’s the Law
All commercial truck operators and drivers are governed by federal laws and regulations pertaining to load size and type, routes and zones, safety, driver training and rest, and more. In addition, each state maintains laws and regulations specific to those jurisdictions.
In New Jersey commercial truck owners and operators are subject to oversight by the state Department of Transportation and Motor Vehicle Commission. In Pennsylvania commercial truck owners and operators are governed by the Pennsylvania Department of Transportation and Pennsylvania Division of Motor Vehicles.
Victims of trucking accidents or their loved ones may be entitled to financial compensation for medical costs, lost wages and pain and suffering from the driver of the truck. In addition, in some cases third parties also may be liable for damages, injury or death.
Many trucks are merely operated by the drivers and are owned by companies which are responsible for the maintenance and safe operation of the vehicles and the training and on-road behavior of their drivers. Under joint and several liability law, victims of truck accidents maybe able to collect and/or all of the awarded compensation and/or damages from either or both of the parties deemed liable. For example, if a truck driver is found negligent in an accident but is financially unable to settle an award the plaintiff may obtain full recovery from the owner of the vehicle.
